Terms of Purchase

WARNING! THIS IS A LEGALLY BINDING AGREEMENT THAT GOVERNS YOUR USE OF THE TRIBEES MARKETPLACE

Capitalised terms used in these Terms of Purchase have the meaning given to them in the Website Ts & Cs unless the context otherwise requires.

  • The Marketplace

    • Tribees’ Marketplace is an online marketplace platform where Shoppers can discover and purchase unique Products directly from Vendors.
    • By shopping on the Marketplace, available on the Tribees’ Sites, you agree to be bound by these Terms of Purchase which are additional to and supplements our Website Ts and Cs (together, the “Terms of Purchase”)
  • Purchasing Products

    • By shopping on the Marketplace, you understand that:
      • you are not buying from Tribees, but directly from Marketplace Vendors;
      • you must pay the requested purchase price (and any requested shipping and transaction fees) by valid payment method in connection with the Product you wish to purchase;
      • each Vendor may have their own individual Vendor Policies; and
      • you assume all responsibility if you provide your own details and materials in relation to an order.
    • By making a purchase from a Vendor, you agree that you have:
      • read all Product descriptions and Vendor Policies before making a purchase;
      • submitted appropriate payment for Product(s) purchased; and
      • provided accurate delivery information.
    • Once an order confirmation has been received, only a Vendor may cancel transactions. If you want to cancel an order, you'll need to contact the Vendor and ask if they can cancel it for you. The Vendor can either accept or decline your cancellation request.
    • By using a third-party service, you may also be subject to an agreement with that third party. For example, PayPal is a third-party service provided by PayPal Holdings, Inc. and is subject to the PayPal User Agreement . Apple Pay is a third-party service provided by Apple Inc. and is subject to the Apple Pay Terms and Conditions. Google Pay is a third-party service provided by Google Payment Corp. and is subject to the Google Pay Terms of Service for US users , non-US users , and India residents. Payment methods made available by Stripe are third-party services provided by Stripe, Inc to buyers and are subject to Stripe’s Services Agreement and Privacy Policy.
    • It is prohibited to share contact information for the purposes of evading the checkout system on the Marketplace. If you need to discuss the details of your order with your Vendor, please keep your communications via the Marketplace.
  • Reporting or Returning Products

    • In United States, consumers have certain legal rights to obtain a refund from a business for goods or services purchased. For example, if the goods or services are faulty, not fit for purpose or don't match the description.
    • Although Tribees is not a direct party to a transaction between a Vendor and a Shopper, we may provide support in the event that your order does not go as expected and you are unable to reach a resolution with the Vendor directly. If you experience an order issue, the first thing you must do is contact the Vendor. Vendors should be given 72 hours to try to resolve the issue. After this period, you can contact Tribees regarding an unresolved order issue in the event of non-delivery, damage, or if an item you receive is not as described in the listing.
    • You may receive a full refund, including all taxes and postage costs in the following circumstances:
      • Products are not delivered, and do not arrive when expected. All Products should be dispatched within the Vendor’s stated processing times, and delivered to the address provided by the Shopper at the time of purchase on the Marketplace. Updates to processing times or delivery address through Accounts or other informal channels will not qualify. Please note that if an item was dispatched and has a tracking number, you may be able to open a delivery company claim by directly contacting the delivery company;
      • Products arrive damaged and are not packaged to withstand handling in transit;
      • Products do not match the listing description. Products received should not be significantly different from the listing description or photos. We may ask the Shopper to provide us with documentation to demonstrate that the item is significantly different. Here are a few examples of qualifying scenarios:
        • the item received is a different colour, model, version, or size;
        • the item has a different design or material;
        • the Vendor failed to disclose that a Product is damaged or is missing parts;
        • the Shopper received the incorrect quantity of items (e.g., the Shopper purchased three items but only received two);
        • the Product was advertised as authentic but is not authentic; or
        • the condition of the item is misrepresented.
      • If Tribees determines that the above circumstances have occurred, the Vendor will be notified that it must refund the order, including original postage and return postage. Wherever a refund request is escalated for Tribees’ review, we will evaluate the claim to the best of our ability. Please be prepared to supply additional documentation if requested.
      • To the extent permitted by law:
        • Tribees has the power to decide, in its sole discretion, if a refund request should be approved or rejected; and
        • you will have no legal claim against Tribees in connection with such decision.
      • You will not generally be entitled to a refund for the following reasons:
        • if Products have been altered, used, worn, washed, or discarded after receipt;
        • if Products are received after the agreed-upon delivery date due to delivery delays;
        • if Products are returned without a return agreement;
        • if Products are accurately described but don’t meet a Shopper’s expectations; or
        • if cost of postage are in dispute.
      • Each Vendor may also have their own return policies and you acknowledge that not all Vendors may accept returns without legal justification.
      • All Products sold by Vendors on the Marketplace should comply with our Products Policy. However, Tribees cannot pre-screen all Products sold on the Marketplace and therefore does not guarantee or endorse any Products sold on the Marketplace, any content posted by Vendors or Ambassadors (such as photographs or language used in listings or shop policies) and Tribees cannot guarantee that Products listed in Stores accurately meet their description or are available as described.
      • By using the Marketplace, you understand that Tribees may use your personal information for the purpose of resolving disputes.
  • Communications and Reviews

    • You can use your Account to communicate directly with Vendors, including to ask any questions you have about a Product or order. Your Account may not be used for the following activities:
      • sending unsolicited advertising or promotions, requests for donations or spam;
      • harassing or abusing a Vendor;
      • any communication which is not compliant with our Code of Conduct or User Content Warranties in the Website Ts & Cs
      • interfering with a transaction or the business of another Vendor or Shopper - Interference occurs when an Account intentionally interferes with a Vendor’s Store in order to drive away their business (and is prohibited); or
      • exchanging personal contact, financial or other information for the purposes of evading the checkout process on the Marketplace, including phone number, address, email, social media handles, external URLs, instructions for money transfer, etc.
    • You agree to use caution when exchanging any personal information which is not strictly necessary for the completion of a transaction.
    • You may also use your Account to leave a Product review or rating or discuss issues and disputes with Vendors, but you must not:
      • publicly post to demonstrate or discuss a dispute with a Vendor; and
      • purchase from a Vendor for the sole purpose of leaving a negative review.
    • If you receive or become aware of a message or activity which violates these Terms of Purchase, please contact us immediately.
    • We reserve the right to remove any content whatsoever that violates our policies or Website Ts & Cs.
  • Changes to the Terms

    • We reserve the right to modify the terms of these Terms of Purchase at any time at our sole discretion by giving you written notice and your continued use of the Marketplace after any changes to these Terms of Purchase will signify your agreement to be bound by the amended version of these Terms of Purchase.
